      Applications have been submitted for planning permission and listed building consent for internal alterations and the building of a 65 sq.m single storey ‘orangery’ at the rear, which will contain a living area with stove, a kitchen and a utility room. The property lies on the east side of Mansionhouse Road, south of Grange Road, backing onto Lauder Road. The alterations include the removal of the southern half of the rear ground floor wall of this B listed villa. The proposals also include widening the driveway vehicle access to 4.6m.

      The applicants have submitted visualisations of the proposed orangery from the front, from the rear (south) and the rear (north).

      Detailed drawings of the proposals are available from the Council’s planning portal at 20/02685/FUL and 20/02686/LBC. The closing date for comments on the proposals is 7 August 2020.

          The applications were withdrawn by the applicant on 9 September 2020. We understand that discussions with the Planning Officer indicated that the applications would not have been approved in their original form. The applicant has stated an intention to submit revised proposals incorporating:

          – reduce the overall footprint
          – reduce the roof height
          – omit the driveway widening
          – retain a larger element of the stone wall to the existing rear facade, which will be left exposed and celebrated in the new extension.

            Revised applications 20/04660/FUL and 20/04661/LBC have now been submitted to the Council for assessment. These no longer include any widening of the vehicle entrance.

            Comments on these revised applications can be submitted until 27 November 2020.

                New applications have been submitted for planning permission and listed building consent (LBC). The proposals are described as “Single storey rear extension and glazed link to existing dwelling house”. The drawings showing the proposals can be viewed on the Council’s planning portal with reference 21/01731/FUL and 21/01732/LBC.

                The closing date for public comments to the Council on these latest applications is 7 May 2021.

                  The Grange Association submitted this objection to the proposed ‘glazed link’ at the front of the property. That element was removed from the proposal and the application for the single-storey rear extension was granted in July 2021.

                  A new planning application 21/06558/FUL has now been submitted for 24 Mansionhouse Road. This latest proposal is for a home office to the rear of the existing garage, wholly detached from the main house. LBC will not be required because “development within the curtilage of a listed building which is not physically attached to listed structures does not require listed building consent”. The closing date for comments on this latest application is 28 January 2022.

                      New applications have been submitted for planning permission and listed building consent (LBC). The proposals this time are described as “Rear extension and internal alterations”. The drawings showing the proposals can be viewed on the Council’s planning portal with reference 22/02642/LBC and 22/02641/FUL. These latest proposals appear very similar to those that were finally granted as 21/01731/FUL and 21/01732/LBC in July 2021.

                      The closing date for public comments to the Council on these latest applications is 8 July 2022.

                        A further new application has been submitted for planning permission at 24 Mansionhouse Road EH9 2JD. This latest proposal concerns the planned rearward extension of the garage to form a home office. The original application for that work was granted in April 2022, after we had submitted these comments in the light of the concerns that some members raised with us. Items 2 and 3 of our comments were addressed in subsequent amendments.

                        The latest proposals are described as “Extension to garage to form home office”. The drawings showing the proposals can be viewed on the Council’s planning portal with reference 22/02711/FUL. It is not immediately apparent how these proposals differ from those already granted as 21/06558/FUL.

                        The closing date for public comments to the Council on these latest applications is 8 July 2022.

                          The proposals 22/02641/FUL and 22/02642/LBC for the rear extension to the house were granted on 21 July and 18 July 2022 respectively.

                          The proposal  22/02711/FUL for the rearward extension of the garage was granted on 10 August 2022.

                          On 1 July 2022, a request 22/00397/EOPDEV was received by the Council for enforcement action concerning alleged unauthorised alterations to the listed building involving the installation of metal fence panels.

                          This led to the submission of applications 22/04415/FUL and 22/04416/LBC for retrospective permission for new boundary gates and fences and a new internal access gate.  The proposals were modified prior to approval on 3 November 2022, to remove the solid elements of the new fencing.  The Planning Officer noted: “The removal of the ‘Header’ and ‘Footer’ elements of the fence allows for a greater degree of visual permeability and would relate harmoniously with the existing boundary treatment.”

                            There are now two new applications for planning permission.

                            • There is a planning application for which the proposals are described as “Amendments to consented house extensions and erection of glazed link structure”. This would involve the replacement of the garage and the creation of a gym and other rooms behind it, together with the creation of a glazed link joining the new structures to the main house. The drawings showing the proposals can be viewed on the Council’s planning portal with reference 22/06428/FUL.

                             

                            • There are also applications for Listed Building Consent (LBC) and planning permission described respectively as “Alterations to existing dormers and internal alterations within attic space” and “Reconfigure dormers into single dormer with french doors and balcony with railing detail“.  This would involve the reconfiguration of the attic space to create a master bedroom with a new dormer window to the rear with a balcony at second floor level.  These drawings can be viewed on the Council’s planning portal with reference 22/06425/LBC and 23/00044/FUL.

                             

                            The Grange Association has submitted this objection about the proposed rear balcony at second floor level.

                             

                            The closing date for comments on 22/06428/FUL and 22/06425/LBC is 3 February 2023.  For 23/00044/FUL the closing date is 10 February 2023.

                              Application 22/06428/FUL was amended in late May 2023 to reduce the depth of the garage and gym by 1m (0.5m reduction for each of the garage and the gym), thereby reducing the projection beyond the rear wall of the neighbouring property. This application remains “Awaiting Assessment”.

                              A corresponding application 23/02134/LBC has now been submitted for Listed Building Consent (LBC) giving more details of the proposed fixings of the glazed link to the original listed building. The closing date for comments on this LBC application is 23 June 2023.

                              Applications 22/06425/LBC and 23/00044/FUL also remain ‘Awaiting Assessment’, concerning the proposed attic alterations and new second floor dormer with balcony.

                                The applications 22/06425/LBC and 23/00044/FUL, concerning the proposed attic alterations and new second floor dormer with ledge, were both refused on 1 June 2023.

                                In refusing planning permission (23/00044/FUL) the Case Officer noted:

                                The dormer roof ledge detail will provide a potential balcony area which will cause loss of neighbouring amenity.  Although properties are already overlooked by windows, the French window with a ledge detail has the potential for a balcony and would formalise this feature. The agent’s suggestion of a condition to ensure this is not used as a terrace is not a reasonable condition.

                                In refusing Listed Building Consent (22/06425/LBC) the Case Officer noted:

                                …. the balcony ledge detail would have a detrimental impact on the traditional character and appearance of the listed building’s roof and fails to preserve or enhance the special architectural character of the listed building and its setting, and contradicts HES and Council guidance.” …. “The impact of the flat roof area would be an incongruous addition to a traditional slate roof form which contributes to both the house’s historic character and appearance and wider appearance of the conservation area.

                                The applicant has three months, until 31 August 2023, to lodge requests with the Council’s Local Review Body (LRB) for a review of the refusal of planning permission, and with the Scottish Government’s Department for Planning and Environmental Appeals (DPEA) to appeal the refusal of Listed Building Consent.

                                Separately, the application 22/06428/FUL, concerning the proposed gym extension to the garage and the glazed link to the main house, was granted planning permission on 29 May 2023. The corresponding application for Listed Building Consent for the attachment of the glazed link to the main villa, 23/02134/LBC, remains pending a decision.
